President Obama invokes executive privilege in Fast and Furious gun scandal

"Let's walk through this complicated situation: For years federal law enforcement has been running sting operations in Mexico, sending American guns down there to see who is buying them and where they are being used. Unfortunately, the feds lost track of some of those guns and one of them turned up in the killing of Border Patrol agent Brian Terry. Congress wants to know who was responsible for the screw up. Attorney General Eric Holder testified that he did not know about the 'Fast and Furious' program until very late in the game. Some doubt that, and a Congressional committee has requested all Justice Department documents pertaining to the matter, but Holder will not turn them over. Today President Obama invoked executive privilege, saying he can not reveal private advice, and therefore he is ordering the Justice Department not to turn over documents in which such advice is present. The House committee rejects that argument and says the President and Attorney General are covering up the situation; today that committee voted to hold Eric Holder in contempt. All this will be adjudicated in the courts, which will take forever. Some believe that's the plan â?" keep the documents secret until after the election. There's no reason the President can't redact any advice given in private, just black it out. Congress doesn't care about advice, they care about how the sting went wrong and who's responsible. The privilege deal is a ruse and it's obvious. Release the documents, Mr. President, and redact what you think should be held confidential. President Obama campaigned on transparency, but this is obviously the exact opposite. Release the documents!"

The Factor asked political strategist Dick Morris whether the Fast and Furious gun-running scandal could affect President Obama's reelection chances. "The President has wrapped Eric Holder in executive privilege," Morris said, "which means this is now his scandal and he's withholding the documents. To raise the issue to this level is just dumb â?" nobody in the mainstream media was paying any attention to this scandal, but now everybody's going to be covering it, it will be a big deal." The Factor theorized that summertime apathy may help the administration: "Most Americans are not watching the news, they're not reading the newspapers, they're disengaged. The folks are not going to rally to this and I think that's what the Obama administration is counting on."
NBC makes a controversial edit of a Mitt Romney speech

NBC News, which recently aired a deceptive audio clip of George Zimmerman, has now broadcast a misleading and doctored quote from Mitt Romney on Andrea Mitchell's daytime news show. The Factor invited reaction from former Clinton adviser Lanny Davis. "I don't think Andrea Mitchell would do that," Davis declared, "I don't think she knew. This is a horrible example of taking a quote out of context. Both sides are doing this and Michael Steele and I are saying we're fed up. We think people in Washington want solutions, not this kind of stuff." The Factor warned Davis that his campaign for greater civility is akin to tilting at windmills: "There is money to be made in the partisan precincts on television and radio, so they're not going to stop attacking because they make money attacking."
Defense rests in the Sandusky trial

Former Penn State football coach Jerry Sandusky, charged with 51 counts of child abuse, chose to not take the stand in his own defense. The Factor asked attorney Jeffrey Gold about that decision. "He has a constitutional right to not testify," Gold said, "and the defense made a strategic calculation that he didn't need to testify. They feel they put on enough of a defense to create some doubt in the jurors' minds. The question is whether the jurors want to believe in Jerry Sandusky and whether the defense gave them something to hook on to." The Factor expressed doubt that anything can override "the tremendous amount of graphic testimony, not only from the victims but also from a witness."
Occupy protest in Oakland disrupts a conference discussing the problem of child sex trafficking

Last week, when authorities in Oakland put on a conference to discuss the problem of child sex trafficking, loons from Occupy Wall Street protested and called it "a conference of pigs." The Factor analyzed the situation with Joe Alioto Veronese, a former member of the San Francisco police commission. "This is crazy even by San Francisco standards," Veronese said, "and it's a continuation of anti-police action. It's being flamed by the total lack of leadership from the mayor's office in Oakland. These people are a danger to society and they have hijacked the name of the 'Occupy' movement." The Factor condemned the protesters as apologists for child abuse: "Almost every decent person, no matter their political beliefs, would say child sex trafficking is heinous and must be wiped off the face of the earth. But these 'occupiers' see this as oppression of sex workers."
Dennis Miller on Obama's new immigration policy

The Factor asked Dennis Miller to opine on President Obama's Friday decree that certain illegal aliens will no longer be deported. "How would you like your entire presidential legacy to be found in 6:45PM Friday document dumps?" Miller asked. "That's when my man does all his great work, as he's heading out the door for the weekend. I know he owns GM already, but if this is going to be his form of governance he should buy Fiat, too, because this is just presidential fiat. I think it's going to catch up to him, even moderates will say he can't just call these shots by himself." Miller also commented on the study that identified America's "most manly" and "least manly" cities. "My theory is that the manliest city in this country," Miller told The Factor, "is whatever city you're in at that particular moment. And the least manly city is whatever city I'm in."
Watters' World: Jesse visits the tattoo nation

Factor producer Jesse Watters sought, found, and spoke with some men and women who sport multiple tattoos." He returned to the No Spin Zone, sans ink, to report his findings. "Obama has the tattoo vote locked up," he said, "they love him. One guy was an anarchist, but everybody else was an Obama supporter. And of the 45-million Americans who have tattoos, 70% say they have them where you can't see them. So it's statistically possible that we may have Factor staff members with tattoos that we don't even know about." Watters also unveiled an ingenious plan to supplement his income. "I'm thinking of getting DickMorris.com tattooed on my bicep. He'll pay me and I need the money."
