Well the gallstones are out, that was fun. Yesterday, I went to one of the finest hospitals in the nation, St. Francis. They've got all these gallstones out there in my stomach for three weeks. And at the end of the broadcast I'm going to tell you a little bit about what would happen and what would have happened had I been a Canadian citizen. Going to compare what the system is here to the system in Canada.
But first, very important update on the Kavanaugh situation. It seems his accuser is not going to testify under oath before the Judiciary Committee on Monday. You know to me, you know, why not? Why not? Right? You're going to shake the country up, you're going to shake our government up, Dr. Ford from out there in California, you have two attorneys now one very, very, very, very far left attorney and another one Lisa Banks who have never heard of. Why can't you come to Washington next Monday and tell your story under oath to everybody, doesn't want to. Instead she wants an FBI investigation, it's not in their jurisdiction to do that. It's a local situation. The FBI did six background checks on Judge Kavanaugh, didn't come up with anything. You now, after thirty seven years are demanding an investigation, you an American citizen, who should be heard, should respectfully treated, you are demanding. It's not going to happen. It's not the way our system works now. In front of the whole world, come to Washington on Monday all right, testify under oath about what you believe happened and everybody would hear you. But you're not going to do that, are you? So the Judiciary Committee Chairman Senator Chuck Grassley says I'll send people out to you. We'll take your testimony in California. I don't think that's going to happen either because this is all about delaying. You'll hear the Democrats on Monday because Judge Kavanaugh is coming in. All right. Scream, scream, scream, delay, delay, delay, delay, FBI, FBI, FBI, that's what this is all about. That's why it's happened. Now, I don't know what happened 37 years ago, I do not know. I'm not going to make any, unlike the political director of ABC OK, who said outrageous things. I'm not going to do that. That's dishonest. I don't know what happened. I think President Trump handled it well, we want to hear what Dr. Ford has to say. Let's hear it, under oath, in front of the Judiciary Committee. Nope, not going to happen.
So, my prediction and I could be wrong, Judge Kavanaugh will come in and doesn't know anything about it. He'll be abused, and I use that word absolutely correctly. The Democrats on the Judiciary Committee especially, senator Mazie Hirono, who is incredibly, incredibly irresponsible in this. He'll be abused, accused, abused all of that that. The Judge will sit there that under oath, he knows it's a felony to lie under oath, who would know better, tell his story. After that Judiciary Committee will clear him to the full House and the House will vote. I don't know how the House will vote. There'll be threats to Democrats, threats to Republican senators like Murkowski in Alaska and Susan Collins of Maine, outright threats. They'll be screaming in a hearing on Monday. We already know that people have been paid to show up, to scream and disrupt and accuse and hold signs smearing Judge Kavanaugh. One more thing before I get to some sound bites. If Judge Kavanaugh does get confirmed the Supreme Court I would not make a statement publicly if I were the judge. I would have my wife make it and explain to the American public what the Kavanaugh family has had to endure. That's it short statement, in front of the cameras. That's what I would have. Because if this doesn't stop this is tearing the country apart, this is tearing the country apart ruining lives.
Senator Hirono, Hawaii roll the tape.
"For any of us to have dealt at all with the experience of sexual trauma knows that this is a very particularly damaging kind of experience and you do not treat a person who has gone through this like, oh well hey how about this. You know I think it's appalling and I'm totally disappointed that all of these people have come forward to say oh we should hear from her and now that she's expecting a modicum of fairness so she's not revictimized, are now saying well if she doesn't want to testify we should just go ahead. That is additional callousness from my colleagues. I am totally appalled by."
The key word there is revictimized. No victim here. There's no victim unless you have proof of a crime or proof of an act that has been destructive. So, we know that Senator Hirono has convicted Judge Kavanaugh based on her own biases, not don't any evidence, her own biases. It's beyond the pale, way beyond any pale. OK.
Second soundbite. God knows why but Hillary Clinton has now inserted herself into this controversy. Roll it.
"Your husband when he was president faced allegations that were not the same as this certainly but had connections to these kinds of old allegations from years ago. And I know that you had concerns at the time, your husband certainly had concerns at the time that he never really had due process to defend himself from allegations like this. Have we learned anything over the years about due process not just for the accusers but also for the accused?".
"Yes there should be due process for everyone involved. And I think that's what Dr. Ford is asking for. She's asking for due process, she's asking that there be an investigation. You know at the end of the investigation, she might very well decide not to pursue her willingness to testify. She might say well you know there is no way to ever prove it."
All right. So before the accuser wants due process. Well she had 37 years to get that done. Didn't she? But now she wants due process but at the end maybe she'll decide not to pursue. So what happens to the Kavanagh family? Now Mrs. Clinton is foolish and I use that word again, absolutely accurately to even bother with this because as we all know and as history records, she attacked many of the women who accused her husband of misbehavior that she not she attacked those women based on nothing. She didn't know anything about it. James Carville their adviser at the time, was throwing out all the stuff nuts and sluts and all of this. He didn't know how could anybody know. I'm not saying all the accusations about Bill Clinton were true. I'm not saying that, they were never adjudicated in a court of law. Clinton was one of the leads in disparaging the accusers not the victims. Notice I didn't say victims, in the lead of that and now all Dr. Ford wants is due process. Well where was due process when you were laying out Kathleen Willey and any others. Where was due process then? See what I'm talking about here? Americans have short memories, it's my job to keep track on top of all of this but I just shake my head, I can't believe some of the things that are being said. Matthew Dowd, the aforementioned director of ABC's political operation, entire operation, called Clarence Thomas a quote sexual predator unquote. How could that happen? How could Disney, which owns ABC News allow that statement to happen? Matthew Dowd the head of your political unit, this is beyond the pale. Our whole fabric of fairness in this country is being torn to pieces right before our eyes.
Last soundbite Dianne Feinstein, who obviously held back Dr Ford's accusations, obviously did it with the intent of disrupting Kavanagh's confirmation at the last minute. Feinstein, go.
"I have no say, I'm the lead Democrat, so this is all up to the Republican side. I can't say everything's true, I don't know.".
That's about the first time I've heard any Democrat in the last few days say anything truthful. Because she doesn't know. Now why did you hold back this accusation, when you knew about it in July? Why? Not answered. Not answered by the New York Times or any of the others. If I seemed to be exasperated I am because I see the danger. And I went through this myself.
Brett Tolman is a former U.S. attorney in Utah, knows all about this and he's also going to talk about the documents that President Trump has ordered to be put forth and a Russian collusion investigation. But first Kavanaugh, you're a prosecutor, former prosecutor, this case lines up on your desk. What do you do?
"You dismiss it immediately. The states have primary jurisdiction over any sexual assault allegation unless that occurred in Indian country. You know it's fascinating to me because when when you mention Feinstein you know her delay tactics when Joe Biden received the Anita Hill information he immediately shared it with the Republicans and the White House almost, you know as soon as he received it."
And he was ahead of the Judiciary Committee?
"That's correct.".
Go.
That's right. And they shared it and then what the process is, staff will investigate it, the FBI everyone's clamoring for the FBI, those that are doing the background checks are retired agents, some not even having investigated crimes during their career with the FBI. They would interview witnesses compile the statements and then give that to the staff of the judiciary, who has the primary role to investigate these sensitive matters. That didn't happen here. It was held on to, none of the normal protocols that have occurred over the last six nominees was it was followed. And instead you had this theatrical last-minute revealing right before the vote without naming names and supposedly to protect the confidentiality of the alleged victim in this case, it is a tragedy of process just to begin with."
So based upon what you know now, the accusation coming forward so many years later and even though it was raised in a therapy session in 2006 whenever it was, the name Bret Kavanaugh never was raised until now. If the FBI did investigate, I don't know how they could. All right because now nobody's even remembering if there was a party, I mean it's so murky and so nobody knows. OK. If the FBI did investigate, could it possibly go into a court situation?
"No. I mean you have statute limitations problems. The FBI doesn't have jurisdiction, the Maryland detectives, you know sex crimes detectives would have jurisdiction. There's no recollection of where the party occured or who was there, who might have been intoxicated or not. She identifies two individuals that were there, both deny. So what you have is no ability to corroborate any statements, no physical evidence that could exist and apparently there was a woman yesterday who said that it was the talk of the high school, a few days after the party but then withdrew the post that she made and it may have been a fake. So, what we see now is the rest of the world, the Twitter sphere, or whoever.".
Yeah, all that garbage. There's another there's another alleged witness named Patrick Smwth, just emerged. He attended the same school that Kavanaugh did, Georgetown Prep and he somehow his name got associated with Dr Christine Ford and he said flat out, "I'm issuing a statement today to make it clear to all inviolved, I have no knowledge of the party in question, nor do I have any knowledge of any allegations of improper conduct she has leveled against Brett Kavanaugh." unquote. So you're right. I mean there's nothing here at all. Now there has to be probable cause, does there not? To launch an investigation. Probable cause has got to be a little bit more than one person walking into a police station saying he did that to me, she did that to me because if that were all, OK, everybody in the country could be accused of a crime by somebody who didn't like them.
"Well that's right. I mean we have standards in place and here there wasn't a reference to it to law enforcement or to any investigative authority until 2018.".
Ever! Until the confirmation hearings. So look again, I want to be fair I am, I am just livid at the state of the country right now, where accusations become facts. The media is so dishonest they don't search for the truth, they don't care. The liberal media has got their person, Dr. Ford trying to knock out Kavanaugh because nothing else worked. All right. The Senate minority leader in the Judiciary Committee, Feinstein holds the evidence back, nobody holds her accountable for that. I mean if I'm the Senate Ethics Committee I'm right on that. I'm right on that. Why did you hold that back? This is disrupting the whole nation.
"You know, Bill I've been one that prosecuted sexual assault crimes during my career. I had a sister when I was young, she went to college and she was kidnapped and raped at college. Very traumatic experience for our family.".
Of course.
"I have been and I prosecuted the kidnapper of Elizabeth Smart. I've made it a passion of my prosecution to remember the victims in these cases. I cannot see a badge of corroboration or credibility that stands out in this accusation and that is to me very troubling because I have also seen and witnessed false allegation cases that have destroyed lives and when you have a refusal to testify I know how badly my sister wanted to bring you know, her rapist to to justice and was never able to, I know it was traumatic. She had years of counseling. I for the life of me, you come forward finally, you make that decision and then you refuse, it only screams of politics and that it makes me afraid of what you've outlined, that we're in a day and age where we convict without probable cause and without due process.".
Well certainly the Senator from Hawaii has. Senator from New York, Chuck Schumer has, Senator from New York Kirsten Gillibrand has and many, many more, just makes me sick.
OK so we can expect, I think next week these documents about the FBI's Russian collusion investigation from the beginning to be put forth. Now the Justice Department says it's going to redact some stuff, I assume that's names of informants, maybe judge’s names, that they want to protect. I assume we are going to get the gist of whether the FBI went into that Russian collusion investigation with an obvious bias against the Trump administration. This is what I assume will happen. Do you concur?
"I do, I do concur, and I will also add that I've been around classified documents, I have been involved in the process of declassification. It is surprising sometimes what is classified, I am here to tell you that there are very few documents I came across, you knew them when you saw them because they had information about some of our intelligence gatherers, but this kind of information seems more protected by political action than it does out of security. The same ones clamoring for you know that this is reckless and careless in the intelligence community to declassify, were asking us to declassify documents during after 9/11."
Of course, it's so political. But here is my question. The White House counsel is going to see the redacted version, I would assume before it's released to the public. President Trump has the power to unredact what the Justice Department has done. So it remains in the President's power to put out what he thinks the American public should see, right?
"It does he has absolute authority over classification."
So, no excuses, no excuses.
"That's right. If he decides not to...".
That would reflect poorly on President Trump.
"Yes absolutely.".
If we get those memos and those techs from the FBI and it's awful gobbledygook and we don't know what's going on that's on, Mr. Trump. So we'll see. And we'll have you back of course, the second that breaks we'll wake you up, send someone to Utah and get you on the air.
"That sounds good.".

OK. A new Ipsos poll out today and this is predictable, do you support or oppose Supreme Court nominee Brett Kavanaugh's nomination? 31 percent support, 36 percent oppose. You would think that with all the bad publicity directed toward the Judge. Doesn't mean anything, this kind of stuff waivers back and forth. The only thing that depresses me is that some people believe allegations, they don't take the time to step back and say we don't know and let's see what happens.
I want to bring in professor Jeanne Zaino, teaches political science and Iona College and that's why I have my shirt on Jeanne. Iona shirt just for you. So I guess this is the buzz of the class, is it not?
"It is! And by the way, we love the shirt, thank you so much. It's quite a honor. And it is, I'm actually teaching a Supreme Court class this semester which was just incredibly timing given the nomination. Of course, we spent we spend some time watching past confirmation hearings particularly notable. So had just been watching last week, parts of the Anita Hill, Clarence Thomas confirmation hearing and then to come back to class on Tuesday, this having all erupted over the weekend, was quite stunning and I think to the students they're still trying to wrap their heads around what it all means because of course 1991, they weren't even alive. So they don't recall that hearing."
OK. Let's start with due process in your opinion. Do college students in your class and on the campus of Iona, do they understand what due process is, do they understand the presumption of innocence? Because we have a lot of people in very powerful positions that don't care. They are convicting Kavanaugh right off, right from the jump. Do your students care about that?
"They do. For the most part I think like most Americans some of them get very different views on this particular issue, but we do talk an awful lot about due process and the presumption of innocence. I think most students hopefully at least in my constitutional classes understand that concept. That said, we still have them, I listened to hours of it yesterday, a variety of opinions on what should happen in this particular instance."
But are the opinions emotional? I mean I'm sure you get students to say oh he shouldn't get it, just because the accusation disqualifies him, you're getting people like that, right?
"It's interesting, I did not hear at least they did not verbalize that to me. We did hear some students say this is ridiculous, it was in grade school if it even happened, 35 years ago. How can this be held against someone? And then all the way to the other end of the spectrum which was very much like, we should give her a chance to speak as well as the Judge a chance to speak and we should be able to vet, you know the reality of the situation as far as we can, 35 years later and make that decision or at least allow the Senators to make an informed decision."
That's all logical. But you know the mob isn't portraying it that way. The mob that doesn't like Kavanaugh is using this as a pretense to say he's through, get him out, don't vote on it until after the election. None of that. And we're seeing that on a lot of college campuses, we're just seeing that the people who don't like to have an or for whatever reason are using this as a bludgeon to get him out. You know that's happening.
"Yes certainly that's happening and what we try to talk about is the fact that as far as first of all we want to take a reasonable approach. To your point of course that's happening, this is politics. But besides that, we also want to be clear, in the Anita Hill incident the FBI did take some time, took two weeks to investigate the allegations before they held the hearing. So, the idea that there would be some time to investigate and then hold the hearings is not in my opinion, absurd.
OK. But the difference is...
When Ms. Hill came forward as we just had in a previous interview, Biden gave all the materials to everybody and they didn't hold it back to obviously delay the vote. All right it was OK, we've come across this, take a look at it and let's go. There wasn't the, well we'll go right up to the point and then delay it, so it doesn't come in before a midterm election. You didn't have that then.
"We didn't hear that, although Biden got widely criticized for his behavior during the hearings...".
Sure, because he was a zealot. But he did the right thing in distributing the information, whereas Feinstein held it back.
"I think he did and I think there has been criticism even from Democrats like Dianne Feinstein holding the information, that said, that was a tough call for Dianne Feinstein. But even so, if we step back I don't think it's unreasonable to expect some time to investigate a minimal amount of time and then to hold the hearings. I think that is a reasonable thing to do. But again, it can't be up in until the midterms.".
If the doctor doesn't show up to testify on Monday, as invited by the Judiciary Committee, if she doesn't show up it's not going to happen. Hey Doc, we appreciate it very much that you give us your perspective from a political science instructor and it's always nice to have you on the program.

Yeah, they'll stone me to death. Remember, we played football against Iona and we kicked your butt a couple of times, so I don't know if they're going to like me.

A couple of quickies, the Daily Caller News Foundation received a tip about a call in among radical left groups and listened in on them and the call said that they were paying demonstrators to go and disrupt the Senate Judiciary hearings with Judge Kavanaugh. OK. Go to the Daily Caller, you can see it. This happened to me. OK when I was at Fox and all of a sudden demonstrators showed up. They were all paid. So we know it happens and there was even a call after what they did to me, I had people on the call, OK the Bonnor group, in Washington, engineered the call, same thing. This playbook is happening all the time.
ICE reports that 28 percent of family units who tried to cross the border illegally for one reason or another, or applied for asylum did not show up for their hearing, 28 percent between October 1st 17 and July 31 is 2018. It's about 30 percent. One out of three don't show up, there in the wind, just so you know.
OK my gallstone ordeal. The best hospital in the country, in my opinion, St. Francis takes good care of me over there. You know I'm pretty healthy but everybody has stuff. So I go into the gallstones, I had them for three and a half weeks. First week I didn't know what they were. Second week I got an MRI and I had to get a sonogram and then third week make the appointment, the guy goes in scoops the stones, here I am, out one day. Monica, by the way did a great job last night. OK.
So, I'm an American, I have Medicare, I've worked Medicare, hard for Medicare my whole life and I use it and they fix me and I'm back. I still look like a racooon, still got dark circles under my eyes. I'm sorry that'll go away in a few days, I hope, had big bowl of pasta for lunch today. If I had, if I was a comedian, a comedian I'm sorry all my friends in Canada. If I were a Canadian! How about that! Once Bill just it grammatically correct. If I were a Canadian, not a comedian, some people think I am, I would wait all right average time, 20 weeks before I saw my primary doctor and I got surgery, 20 weeks. All right that's up 115 percent since 1993. Just for an MRI to find out what's going on, 11 week wait. This is single payer healthcare, government healthcare. In Canada 37 million people and we love all of them, almost all of them, 37 million. United States 350 million counting illegal aliens that get medical care. OK. Do the math, do the math. I would wait 11 weeks for the MRI, I'd be like this, bent over, c'mon. Now, I guess you could say, I could go to the emergency room all of that. Okay. Just telling you when you're the single payer government health care stuff. If this ever happens in this country Armageddon. Armageddon.
All right so let's do the mail.

"As a juror on your jury you put together on the Kavanaught story, I have to challenge your first two points. Maybe more information will change in my mind, based on what I've been told so far, I must challenge your statement that there were three people in a room. Yet you go so far as to name the three, any proof they were there?".
The document that came out, that Feinstein has, the letter written by by the doctor out there whose accuser says she, two others were in the room. That's the evidence that's presented to you the juror. Any proof of that? No. Kavanaugh says he doesn't remember that, Judge the other guy says he didn't remember that. But you're the juror, George, you are presented with evidence. It's not proven before you're presented with it. Come on. Have you ever been a juror?
"Second you said we can't say Ms Ford is lying. Why not?".
Because it wouldn't be fair because you weren't there. You don't know that's why. As a juror you have to be fair. Now you may know after she testifies and is cross examined, absolutely you'll know then, but we don't know now.

Beverly, you can believe that if you want but you can't state it as fact Americans are free to believe anything, people believe aliens come down every Wednesday and watch TV with them. You can believe it but you can't state it as fact.

Can't do that. You know you just can't assume that somebody is paid to lie. You can't.

My assessment of the evidence so far was that there was some interaction between Dr. Ford and Brett Kavanaugh, she knew his name. She knew where he went to school. That's all. That's all. Some interaction, somewhere along the line they crossed paths. That's all I've said, I think it's true.

"Can you shed some wisdom on this question, if the information I read is correct, the United States has approximately 30,100 counties. During the 16 presidential election, President Trump won approximately 2600 of these counties. That means Hillary Clinton won five hundred counties but she won the popular vote. Logic would suggest that Hillary won the most densely populated areas and President Trump won the least populated. We feel the country is divided, is this an example of division?"
Sure, sure. People in the in the populated Manhattan, New York City, L.A. ,Chicago basin, tend to be liberal and who rely on government subsidies. People in the rural parts of the nation tend not to. It's a whole different point of view. Sure that's part of the division. That's why we have the Electoral College. So you guys in Idaho and Wyoming and Mississippi aren't locked out of the whole thing. That's why we have it.
