We have opened this up for everybody tonight because it's such an important day in the news. Of course the Mueller report is our lead story. We will spend most of the time on it. Brett Tolman warming up in the bullpen, he will be with us shortly. OK. So Robert Mueller comes out and speaks to the world, eight minutes on notes. He looks tense. I thought he was desperately unfair and I'm not saying this in any political way. He was unfair to a fellow American citizen, Donald Trump. He denied President Trump due process. So in our system which is the best in the world on paper. Unfortunately our justice system is harder. On paper it's the best. You are innocent until proven guilty of a crime. Also if a prosecutor, which Robert Mueller is, under his title of Special Counsel. If a prosecutor does not have enough evidence to charge you with a crime, you are innocent. So Mueller goes on TV and says we don't have enough evidence. In 485 pages. But we're not going to we exonerate President Trump of obstruction. That's brutally unfair, brutally. Roll tape.
"The order appointing me Special Counsel authorized us to investigate actions that could obstruct the investigation. We conducted that investigation and we kept the office of the acting attorney general apprised of the progress of our work and as set forth in the report after that investigation, if we had had confidence that the president clearly did not commit a crime, we would have said so. We did not however make a determination as to whether the president did commit a crime. The Constitution requires a process other than the criminal justice system to formally accuse a sitting president of wrongdoing."
That's false. That's not true. If you read Ken Starr's report on President Clinton, on 11 separate occasions, Judge Starr lists crimes that he believes Mr. Clinton committed. All right the Constitution does not bar Robert Mueller from listing any and all crime. In fact if Mueller has evidence of a crime, that President Trump committed and doesn't list them. Mueller himself can be charged with obstruction of justice. So this is all B.S. What Mueller did today was grandstanding because he's a member of the swamp, doesn't want the swamp to turn on him in Washington. He said, you know what I can't exonerate Donald Trump but because the Constitution says I can't bring charges against a sitting president. Well we we didn't state... That's nonsense. Total B.S. So what Mueller basically did was he cast aspersion, word of the day, aspersion on Donald Trump. And then the second thing was he said to Congress, hey I don't want to do this anymore because I don't have anything. You take it up. You do it. Where upon little Jerry Nadler, who I really dislike, goes out and goes oh nobody is above the law. And you know what. Put up or shut up. It's two years. Thirty million bucks. If that's what you got, he might not have been exonerated? Maybe? That's just bull and it hurts the country. It really does. So there are two areas. So if you read the Mueller report that indicate Donald Trump may have done something he shouldn't have done. The first is firing James Comey. But Mueller can't cite it because he knows, Mueller knows that Comey may well be indicted himself and if President Trump had not fired him, Trump could be criticized for dereliction of duty. Because Comey may be going down soon.
Number two. McGahn. The president's lawyer, in-house, White House lawyer. I have no doubt because I know Donald Trump. That Trump vented to McGahn. Get rid of this. Can't you do something? Can't you make it stop? Can't you make it go away? I'm sure that Trump did that because the man was frustrated. He said I didn't do anything. I didn't collude with anybody. Why. Why is this happening? I do that to my lawyer. Can't you do this? Can't you do that? But nothing ever happened. You can't charge somebody with venting. We charge President of United States with venting. So Mueller puts up this facade and he did it to cover his butt. He doesn't want to testify in front of anybody about anything. So he's going to bring his eight minute statement even if they subpoena him and he's going to read it a statement over and over and over and over. And then if you ask him a question... I don't know.... I have.... Go to the report, we said this in the report. So Mueller just didn't want to do any of that. But again the key here is to compare what Mueller did to what Star did. I know the special counsel has been changed but still you can't state if you are a special counsel that you have evidence that shows this happened. Why have a special counsel if you couldn't do that? Why bother? You don't have to charge. You don't have to recommend even though Starr did recommend. He said you can impeach Bill Clinton on these charges. That's what Star said, 11 separate charges. But to say that oh the Constitution says we can't do anything is just so misleading. Most people don't understand all this. They don't get it. It's complicated. So let's recap. Mueller unfair, brutally unfair not only to President Trump but to the nation. Denied the president due process. He did it because he doesn't want to be scorned by his folks in Washington, the swamp. And he's covering it CYA. He is CYA. I do expect Attorney General Barr to issue these reports soon. Because now the time to do it. Now's the time to do it. And two personal things. There is no question in my mind that Robert Mueller despises Donald Trump, no question. Watching him today. Well he doesn't dislike. He does not dislike Attorney General Barr. He went out of his way to give Barr a few kudos. That's really interesting. But again I think it has to do with the swamp. But I could be wrong. Leave anything out here? There will be impeachment, Nadler will continue with that. No doubt in my mind that's going to happen and then Trump will say I am not giving you anymore and not playing into this dog and pony show. But in the end the Senate never in a million years based upon what's being presented would convict anybody of impeachment, never. So it's all a bunch of politics and has hurt the nation. Stock market, hurting everything. Brett Tolman is our go to guy on all things Mueller. Coming to us from Salt Lake City, Utah. Former U.S. attorney from Utah, he knows the players personally, knows everything. All right Brett, I say anything and you need to correct or put in perspective?
"No I think you're right on the money on what happened here. But I wanted to emphasize something that you highlighted on comparing to the the Starr report. But one thing that's not being talked about, Mueller did not find evidence sufficient for obstruction of justice. Now he dodges the ball and he tries to kick it down the road to Congress. But he had the ability to find that and didn't. And I'm getting a little I think frustrated like everyone on blaming the policy of the Department of Justice. Remember there is an entity in the DOJ. It's called the OLC, whose job it is to it is to interpret the law and issue an opinion. They issued an opinion that charging a president would be against the constitution. So it's not the DOJ policy that is preventing this. They have interpreted that from the Constitution. Mueller had all 30 available to him to say I find these facts are sufficient to make a case of obstruction of justice, even though I can't charge him. I find these sufficient. Now Congress I give those to you. And he did not do that.".
"There is no specific evidence that Robert Mueller put in his report that even if you were in Salt Lake City, a state prosecutor, you could bring in and get an indictment. Am I correct?
"That's right. You are correct. And what's interesting to me you highlighted the firing of Comey. Many people believe that when Clinton first took office and removed all 94 U.S. attorneys, he did so to protect a couple of political allies. That was a theory. Yes. But why was he able to remove all 94 U.S. attorneys? Same reason Trump had every ability even if he didn't like him personally or he had reasons that he didn't think he was going to get a fair shake in the investigation to get rid of Comey. Mueller knew that."
And Comey himself, you got to assume that the Trump administration knew things about James Comey. That he was leaking classified information to reporters which he's admitted. All right. And then he did other things that he shouldn't have done as head of the FBI. You've got to assume that the White House knew that. Why would you keep somebody in office who is leaking classified information to reporters? Why?
"And so far all we've seen is a flurry of defense, defensive posturing by Comey and why? And I think it's it's because of this. There are individuals that behave themselves similarly that were not in such a big position as Jim Comey who have been prosecuted by the Department Justice for such leaking and such conduct as we've seen in the former director."
OK. So let's advance the story now. Mueller's off the stage, maybe Nadler calls him and maybe he doesn't but I as I told Sean Hannity on a radio today and by the way that's posted if you listen to that. A long segment with Hannity. We really get into the micro of what happened to Mueller and it's different from what I'm doing with Brett. I'm doing hard news reporting now, with opinions sprinkled in. This is basically a hard news presentation for Bill O'Reilly dot.com Premium Members and everybody else tonight. But in Hannity It was more of a... this is why it all happened. I gave the why behind it rather than what. Now you have a situation where Mueller's office statement. Maybe he comes back but he's going to stay with what he said he's not going to go out of that because he's smart and he knows that that just opens up all kinds of bad things for him. So that the Democrats in the House that want to impeach President Trump, they believe they have enough to go ahead. Do you believe that?
"I think it's one of the most unfortunate circumstances that Mueller has shifted what we traditionally have prosecutors do. I issued letters as U.S. attorney and as assistant USA Attoyney, I issued letters on occasion to individuals that we were investigating. Not once in any of those letters did I ever indicate that we did not exonerate him. That we could not exonerate them but we couldn't find....".
Do you know any prosecutor? I've never heard of anybody. Even the OJ Simpson case...OJ Simpson Case. OK He did it.
"That's right. You don't want to... I mean when he indicated in that press conference that the... you know the interests of fairness were also he was mindful of. The sad part of that is the most unfair thing you can do is to cast someone in a criminal light when you don't have sufficient evidence to charge them.".
Aspersion, the word of the day.
"That's a good word.".
Muller has the power. Mueller has, and he has the moral obligation to use the power in a fair way. You can't say, well we didn't find it but he... that's not me he didn't do it.
"That's right. And he could have, he could have helped the country out. Not necessarily just heal but to move on to issues that are very important right now. That Congress especially, you could have indicated, I do not have sufficient evidence to make a recommendation that obstruction of justice occured."
That's what he told Barr, according to the attorney general.
"That's right.".
3 separate times.
"That's right. Barr boiled it down. I'll tell you. You made the comment, Why doesn't he like him? I'll tell you why in my opinion. Barr is highly intelligent. You have to be very careful about what you say and how you say it. If you don't know your facts and you don't know the law with him. I've interacted with him I've seen him in action. And I know that Mueller would not want to take him on without having clear facts or the law that was in his favor. I'm not going to find that with Barr. He analyzed what the report was and concluded what should be the conclusion of anybody assessing the report."
The Mueller kissed his butt.
"That's right."
You know so if Mueller had a problem with Barr and the way Barr presented the report to the American people, surely he would have taken a couple of failed shots at him. But no.
"Right and he didn't do that. In fact he said he appreciated that they released more of them than they asked for. All right."
Mueller doesn't like Trump so he implies that Trump is a wrongdoer. But he is afraid of Barr so he is kissing Barr. You know...
"Call it politics".
Yeah but it's politics that shouldn't be in our criminal justice system, right?
"It should not be in the department. It should certainly not be in the FBI."

All right. OK. So I'm going to do tomorrow a big mail thing on your questions and observations. You heard what I had to say. Heard what Brett had to say. Big interview with Sean Hannity posted on the radio about it. I think I covered every. I don't think I left anything out. Once again I do believe that Nadler, as chairman of the House Judiciary Committee will push this impeachment forward. You know everybody speculates ig might help or hurt the Democratic Party in the election 2020. I think that might be true. But it's speculation. What is this regulation is that he's gonna push it. Our President Trump, I would semi-ignore it. Would not play into it. Make it very difficult for those people to get anything. And I keep telling the American people it is over. This is just politics and I'm not playing. That's what I would do if I were the president. Then go about the business of running the country. Which the Democratic Party does not seem to want to do as our series of next reports demonstrates.
We got a major problem and the border. Got a major problem with illegal immigration in this country. And whether Beto O'Rourke sees it or not doesn't really matter. It's there. Over Memorial Day there were more apprehensions of illegal aliens at the southern border ever before this year. I have the stat for you tomorrow. Just came in. It's crazy down there. In New Mexico. All right Mayor Javier Parea. All right of Sunland Park, tiny town near the border has issued a cease and desist order to the private people building portion of the wall on private land. All right. The governor of state, Michelle Grisham doesn't want any barrier. All right. So it's a civil war in Mexico between people who want illegal immigration control and people who don't. That includes the governor and mayor Parea. You guys in New Mexico, you're going to have to decide what kind of state you want. Battle lines are drawn. Very little known story. Trump administration is granting visas to Mexican nationals to come visit their children who are in the United States illegally. In a humanitarian gesture. I didn't know that. Just learned that today. Finally the Pope says that there shouldn't be a border wall and there shouldn't be family separations. So in an interview with Mexican TV this week he says no. No wall. No family separation. What do you expect the pope to say? A big headline Pope criticized Trump... It's not about Trump. What do you expect them to say? I mean the Pope is a person who is on this earth to help poor people, all right. He doesn't want barriers. He doesn't want people taken into custody. He doesn't want families separate. I don't want it either. But render to Caesar. That's what I would tell the Pope if I could talk to him. We have laws and they need to be respected. And you know what? Pope Francis would agree with me. I say with all due respect your holiness. Are you telling people that they shouldn't obey the law? You know if the only way to keep people out of the country is the wall and our law says you have to be accredited to come into the country. There is no moral beef. So I can have a great discussion with Pope Francis, who I think is a good man. He's a kind man. When I see this stuff I go... What do you expect the pope to say? All right.
Interesting brawl in the Supreme Court over abortion. Ruth Bader Ginsburg wants abortion every time, anywhere, for any reason whatever. And Clarence Thomas is against it. So Justice Thomas says you know what, it's eugenics. What is eugenics? Eugenics is the... the definition is the science of improving a human population by controlled breeding. So you kill the weak. That's eugenics. Nazi's did that all day long. So if you have a sonogram and the baby has Down's Syndrome, eugenics. Thomas doesn't like that. Okay. Ruth Bader Ginsburg apparently doesn't have a problem. But the interesting thing is that Ginsburg criticized Thomas for saying that mothers were aborting fetus' and Ginsburg says no you're not a mother until the baby's born. According to the definition of what a mother is. Now moral definitions is quite something else. But on the law, Ginsburg's right. The baby has to be born in order for you to be a mother. The proper term it's expected mother.
Missouri, come Friday no more abortion clinics. Interesting. Finally Oregon, in Salem finally did something that I can applaud. They passed a bill 664 in the Senate that says all public school students in Oregon have to be taught about the Holocaust. I hope they use Killing the S.S. My book is number one. Kids will read that book and number two it spells out exactly what happened. Number three. Every American kid should know about the Holocaust and evil. So Salem finally did something.
Oxford, big prestigious university. They have asked me to speak there four times. I have not been able to get over but it's a big big place. Like the Harvard of Great Britain. Professor Young Hae Chi. He's an instructor in Korea at Oxford's Oriental Institute. You can't say oriental in the United States anymore. That's a slur. You know that? Oriental. Yeah. Anyway Dr. Chi says to his students and in a paper that aliens are mating with humans to come up with a different species to survive global warming. This is Dr. Young Hae Chi. So immediately four or five people that I know came into my mind and go there... That's the global warming alien, I know. If Dr. Chi is correct. Some mail, but first this.But first this...

"My wife and I are extremely concerned by the inspector general's report along with two other reports are continued to be pushed back by the Justice Department. What's going on? Does the swamp have that much power to prevent the release of a timely matter?".
I don't know. But boy if there's ever a time to release those reports it is now. But I can't with any certainty tell you why all this stuff takes so long.

Not going to be treason but it's gonna be some serious stuff. And some FBI people and maybe other agencies, they're gonna go. They're gonna get charged. Just my prediction.

"Federal law takes precedence over state law. How is recreational marijuana legal in several states?".
Good question, Brian. If the federal government wanted to prosecute pot smokers in Colorado, they could and the state couldn't stop them. So say you're smoking a little J or joint or whatever they call it these days. A blunt and you smack dab run into an FBI agent with your little blunt. That FBI agent could arrest you and the state police in Colorado can't do a damn thing about it. But federal government doesn't seem to be much interested in marijuana.

You are mistaken. Hitler's Third Reich called itself the National Socialists party. But that's because socialism had a different meaning in Nazi Germany. It meant that the government controlled the economy, which it did. So Hitler at one time ordered Volkswagen to made cheaply so the German people could buy them for far less than other cars. National Socialism but the Nazi rule was far right totalitarian fascism. Fascism is basically strong man dictator telling everybody what to do.

So here's my final thought. Robert Mueller always had a distinguished career as head of the FBI. He was a vietnam vet. He did a lot of good things and I understand why he prospered in Washington. Very diplomatic man but I didn't like what he did today as I said. I thought it was very unfair. I'd like to talk to Mueller off the air because all my reports say he wasn't an unfair guy throughout his career. But I think that he despises Donald Trump and I think that clouded his judgment all across the board. I think the investigators he hired were all anti Trump people. He should not have done that. I think today's exposition was embarrassing for him. It was so unfair. So it's the way it goes. Robert Mueller will be judged by what he did today.
