"I've been covering the news for 30 years and this Kansas situation is the worst I've ever seen. Dr. George Tiller is operating a late-term abortion mill that will destroy a viable baby up until birthing for a 'mental health' exception, which much of the time is simple depression experienced by the mother. A pro-life advocate told us that Tiller injects poison into the baby's heart while it is in the womb, then removes the dead baby and cremates it. Even if you're pro-choice, you must see the ramifications of this barbaric display. If we as a society allow an undefined mental health exception in late term abortions, then babies can be killed for almost any reason. And in Kansas, hundreds or perhaps thousands of babies have been aborted by Dr. Tiller. The price: $5,000 each. This has nothing to do with 'reproductive rights' or any other euphemism. This has to do with terminating the lives of viable babies because the mother wants to back out of the pregnancy in the late stages. If we allow Dr. Tiller and his acolytes to continue, we can no longer pass judgment on any behavior by anybody. What Dr. Tiller is doing is that bad."

Dan Bartlett, counselor to President Bush, joined The Factor to the firing of Donald Rumsfeld. "President Bush made the right decision, and the timing was right. If the president made a decision like that in the final weeks of a campaign, it would have been portrayed as a crass political decision. The president made the decision based on what is best for the conduct of this war." The Factor contended that firing Rumsfeld the day after the election was a mistake. "Removing the secretary of defense earlier would have given the nation hope that a new direction might have improved the situation. But I want everyone to know that, like him or not, Donald Rumsfeld is a patriot."

Guests: Fox News media analyst Jane Hall & analyst Bernard Goldberg

Media watchers Jane Hall and Bernard Goldberg gave their post-mortems on election night coverage. Goldberg judged that mainstream media outlets were generally subdued. "Are mainstream reporters happy that the Republicans lost? Of course. They like Nancy Pelosi and they like the fact that the Democrats won. But if they were gloating, we would be hearing about it from conservatives, and we are not." According to Hall, any unfairness came from the conservative side. "There were a lot of conservative commentators saying that Republicans didn't lose, but conservative Democrats won. I think that is sour grapes. Spinning by commentators is getting crazy." The Factor pointed out that the New York Times claimed there was a 'funereal' atmosphere on Fox News. "I didn't see any funereal atmosphere. What bothered me was all the softball interviews of Nancy Pelosi after the Democrat victory. Surely when you have the most liberal speaker of the house in history, you might want to get into her views. I want to know how Nancy Pelosi thinks."

Some conservatives are implying that terrorists welcomed a Democratic victory, and columnist and author Mark Steyn generally agreed. "The Islamists have made a bet," Steyn pronounced, "that America is essentially a puffed-up superpower. It has all the bombs and tanks, but that doesn't make any difference if America does not have the will. In a sense, this election confirms their view of that. They understand they can not win in the Sunni triangle, they can only win with American public opinion." The Factor reiterated that only Iraqis can ultimately procure their freedom. "It doesn't look to me like the Iraqi people are going to step up and put their lives on the line for democracy. I don't know if it's possible to win a war in Iraq if the population of Iraq is not going to cooperate."

Baby murdered in Colorado
Guest: Dr. Michael Baden, forensic pathologist

10-week old Jason Midyette was brutally murdered in February, but Boulder County DA Mary Lacy, who bungled the John Mark Karr situation, has not charged anyone with the crime. Pathologist Dr. Michael Baden described the horrific abuse. "This child was beaten for weeks before he died and suffered 28 separate fractures. The only people with the opportunity to do this were the parents. Charges could have been brought immediately, but the longer the district attorney waits, the harder the case becomes." The Factor criticized Lacy for her inaction and silence. "This is one of the worst baby killings we have ever seen. Even if the parents didn't do it, they certainly knew the child was in distress. But no charges have been lodged, and no one even knows where they are. DA Mary Lacy says she can't talk about the case, but that's bull!"

Assistant DA suicide over child sex sting

56-year old Louis Conradt, an assistant district attorney in Texas, killed himself after being caught soliciting a 13-year old boy via the Internet. Conradt was nabbed in a sting that lured predators to a home in Murphy, Texas. Murphy Mayor Bret Baldwin told The Factor he disapproves the sting operation. "I am upset because these people did not need to be brought to our town, they could have been arrested at their homes. This happened on a day when kids were out and they were parading these types of people through our neighborhoods." Xavier Von Erck, who helped set up the sting, called the mayor disingenuous. "Internet predators will not tell a decoy where they live. For them to come to a central location shows intent. The mayor wants the police chief and city manager fired for having child predators arrested."

Britney Spears sex tape case dismissed
Guest: Attorney Kimberley Lerner

Singer Britney Spears, who has just announced her intention to divorce, is also on the losing end of a lawsuit. She had sued "Us" magazine for reporting rumors that she made a sex tape with her husband. The judge threw the case out, a verdict that attorney Kimberly Lerner applauded. "It was the right decision. The judge said you profit from your sexuality, you French kiss with Madonna, you pose nude, so there were no damages. Nobody's shocked by this and her reputation couldn't be injured." But The Factor argued the other side. "It's true that Britney Spears traffics in a lascivious image. But does that give Us magazine the right to say she did something that is not provable? It strikes me that a judge should not be making a judgment about defamation just because the judge doesn't like what Britney is doing on stage."
