Who is hurting you at the gas pump?
"Those apologizing for the greedy oil companies say it's a 'supply and demand issue,' but that's bogus. OPEC intentionally keeps the oil harvest as low as it can in order to drive up demand, while here in the USA oil companies regulate refining capacity. Add to this the oil speculators who buy oil contracts for delivery in the future. They don't want the actual oil, they just want the paper. Every time the speculators bid up the paper price of a barrel of oil, Chevron and other companies raise the price at the pump. This is obviously a rigged game and working Americans are being hurt big time. Congressman John Larson of Connecticut has introduced legislation that would make any speculator who bids on oil actually take delivery of the barrels. If Congress would pass Larsen's bill, the speculators would be forced out of the oil trading industry. The U.S. economy is getting hammered by oil prices, and unless Congress gets control of the situation, this country will enter a very bad economic period for a very long time. We are all at grave risk."

Obama calls for civilian trials for terror suspects
The Factor welcomed Fox News analyst Karl Rove, who disagreed that speculators are responsible for high oil prices. "There is some speculation in the market," Rove said, "that is having an adverse effect. But there are 30 other commodities that are traded the same way as oil - it adds liquidity to the market. The biggest reason we have high prices today is increasing demand and limited supply. We ought to be drilling more in the United States." Turning to another story, Rove roundly criticized Barack Obama for suggesting that suspected terrorists should be tried in civilian courts. "Let's give them Miranda rights while we're at it," Rove said sarcastically. "These are foreign terrorists, and Barack Obama's mindset is extremely dangerous. This is not law enforcement, this is a war against enemies that hate America."

Gay marriage now legal in California
After a ruling by the California Supreme Court, gay couples can now marry legally in that state. The Factor asked FNC's Monica Crowley and Ellis Henican why 70% of Americans remain opposed to same-sex marriage. "This country was founded on Judeo-Christian ethics," Crowley replied, "and those ethics still resonate today. We've reached a consensus where most Americans - for moral, cultural and religious reasons - believe there should be no marriage, but that gays should have civil unions and domestic partnerships. There is a faith-driven aspect to this." But Henican theorized that most Americans are simply afraid of change. "Social progress always comes gradually. A majority of Americans now support some kind of legal recognition, and Americans are more comfortable with gay marriage than they were when polls were first taken in 2004. Tolerance is gaining ground." The Factor reminded Henican that media outlets celebrate gay marriage, yet average folks remain hesitant. "Americans don't want to be told that their society should be changed. I'd like the folks to make the decision about this, not the pinhead judges."

Far-left starts attacking John McCain
In a TV ad produced by MoveOn.Org, a woman holding a baby accuses John McCain of wanting to prolong the war in Iraq, while another spot claims Republicans don't care about curing AIDS or breast cancer. Rachel Sklar of the Huffington Post defended the ads as fair and effective. "The mother is talking in a way that every mother on both sides of the divide can relate to. They're targeting the fear that this war will never end and will reach into the next generation." But The Factor accused the producers of underestimating voters' intelligence. "Is the American electorate so dumb that they're going to buy this? I think they're going to laugh at these commercials."

Doctors repair
National Geographic will air a television special about Lakshmi Tatma, who was born with four arms and four legs. The Factor welcomed surgeon Sharan Patil, who led the team of doctors who operated on the 2-year old girl for 27 hours. "This was an accident of birth," Dr. Patil explained. "The family was poor and had no benefit of pre-natal checkups or ultrasound, so obviously this was a stunning thing to have a baby with extra limbs. The operation required a tremendous amount of planning, and fortunately the plan went accordingly. The child is near normal and she's functioning well." The Factor praised Dr. Patil for his skill and dedication. "India has some of the finest surgeons in the world, including you. Congratulations to you, and if I ever get sick, I'm tracking you down."
'Is it Legal?' Segment
Parents supplying teens with booze
The Factor was joined by FNC legal experts Mercedes Colwin and Megyn Kelly, who discussed a ruling affecting illegal immigrants. "The Supreme Court dealt with a Nigerian," Kelly explained, "who overstayed his visa. He said he'd voluntarily leave, then withdrew that notion because he said he said he got married. The Supreme Court ruled that he has the right to withdraw his decision to leave." Colwin praised the court for giving illegal immigrants "due process rights." The legal aces also examined the case of two adult women who supervised a wild party involving underage boys. "A 38-year old woman," Kelly said, "was alleged to have sex with a 15-year old boy while the other woman stood by and encouraged her. They could get several years in prison." Colwin suggested that the women may use drunkenness as an excuse. "They were drinking alcohol, and I think that may be a mitigating factor. The defense is going to say these women didn't know in advance what they were going to do."
