I'm exhausted. I hope you're OK. I had to sit through the Mueller hearings today and I have a pretty methodical analysis of it. And then Brett Tolman, who's smarter than I am will come up with his analysis and if you didn't see it you'll know what the heck happened.
So Robert Mueller, himself, I felt sorry for him. He's a patriot. Vietnam combat soldier, decorated. Former FBI chief. Worked in the swamp forever and that might be a detriment to most people but guy could've made a lot more money being a lawyer in private practice. So he's a patriot but he completely not only booted today but now we know he booted his investigation. So let me go through it.
So Robert Mueller looked befuddled, word of the day, befuddled and the reason he looked befuddled is because he was nervous. Because he made a mistake early on by not liking President Trump. Now if you're an investigator, you don't have the like who you're investigating but Mueller was too public about it. Even today you saw he does not like the president. He thinks he's undisciplined. Mueller is a creature of Washington. Trump operates totally opposite than prior presidents have operated. Mueller doesn't have much use for Trump. That comes through.
So therefore anything that Robert Mueller does Visa V Donald Trump is suspect. And he's got to rise above this suspicion and convince the American public that his investigation was fair, was worthy and that he has come to some conclusions. He didn't do any of that today. The reason these two hearings, in front of the House Judiciary and the House Intelligence Committees were held, was that the Democrats who control the committees wanted you, the American citizen to see Robert Mueller and his indignation over President Trump's behavior in the Russian situation. Well if you watch Robert Mueller, you were going, what's the matter with him? What's the matter with him? You weren't thinking about anything else. That's how awkward the whole thing was.
Now first of all here's the over arch, here's what happened. Donald Trump from the beginning knew he did not do anything that compromised his ability to run the country with Russians. Despite Schiff and all the partisans saying hey you want to build a building in Moscow. That's all a bunch of B.S.. Trump knew that he didn't do anything. He didn't know what his individual guys did but he knew he didn't do anything. So he was angry and frustrated at the press reportage because from the very beginning the press convicted Trump of fixing the election with the Russians. So Trump was furious about that and remains furious about it today.
OK. Then Muller is appointed because Trump fires Comey, the FBI chief. Comey leaks illegally stuff to the press through a friend that says Trump may have done something wrong with the Russians and the FBI was hot on his trail. Trump knew it was all bull. He knew it was all bull. All right. He gets angrier. Then his Attorney General Jeff Sessions recusing himself from the investigation. From the Mueller investigation. It should have been that Sessions supervised Mueller. But Sessions didn't want a part of it. And his reason was well I met with some Russians at a party... bogus. OK now Trump's craze because he doesn't have a friendly person in the Justice Department watching all of this. Then Mueller hires all kinds of Democrats as his lead investigators led by Andrew Weissman, who donated to the Clinton Foundation. Now Trump is like this OK. He's crazed and I can tell you that because I talk to him that on telephone way back.
So then Trump starts to talk to his people in the White House. Don McGann, his counsel, Corey Lewandowski. Other people going... we gotta get rid of Mueller, we got to get rid of Mueller, we got to get rid of Mueller. Mueller, Mueller, Mueller, Mueller, Mueller. Mueller became the big bogey man. So Trump is spouting the way Trump always spouts. OK. He's frustrated, he's angry he wants to put this thing out of business. He doesn't want to be hearing this every day of his life but he didn't do anything about it. He didn't do anything, he just vents. This is who Donald Trump is. So what going to charge him with, venting?
OK so all of this is related to Robert Mueller and his investigators by McGann and whoever it may be. Trump is really mad. Mad at Sessions, he's mad at Mueller, mad at everybody. OK. That's the cover up stuff. Right there. But it doesn't rise because Trump never did anything. The collusion stuff was out the window early because there was so much B.S. that the investigators couldn't get anything on the record.
Now let's show you what happened today a little bit. So the first is a Republican congresswoman from Arizona. OK. And she is undercutting Mueller because Mueller said, remember if we had evidence that exonerated the president, we would have written it. Remember that? That was Mueller's big mistake. Number one prosecutors never do that. You never cast dispersions on someone accused of something unless you have proof that he did something wrong. Never do that. So here is the congresswoman from Arizona. Go.
"Mr. Mueller. There's been a lot of talk today about firing the special counsel in curtailing the investigation. Were you ever fired Mr. Mueller from... Were you ever fired as special counsel Mr. Mueller?".
"No.".
"No. Were you... Were you allowed to complete your investigation unencumbered?".
"Yes.".
"And in fact you resigned as special counsel when you closed up the office in late May 2019 is that correct?
"Correct.".
"Thank you."
OK. So we all know that. But it had to go on the record. Now very few prosecutors in this country would ever bring an obstruction of justice charge on something that was discussed but not done. Fact I don't know anybody other than a zealot, maybe the people in New York State and California might but no fair minded... and we'll get to Brett Tolman and ask him that. You don't have a case. You are never going to convict. It's a political prosecution. Now another mistake that Mueller made is that he did not invest, investigate all of the Russian intrusion into the 2016 campaign. He only investigated Trump. He didn't investigate the Clinton campaign and they asked him maybe 20 questions and he kept going, "I can't talk about it, other people are investigating. I can't talk about it. Other people are investigating." Well it was your job to investigate the entire Russian intrusion. And as we know, the Russians were dealing with Hillary Clinton's campaign because Clinton and the DNC gave an outfit money to dig up dirt on Trump, which came from Russia. But he knows that. That's the dossier. So why wouldn't Robert Mueller investigate every part of the Russian intrusion? He doesn't have an answer. He can answer it. Now he says... Well I.... But that's bull. That's bull. Your job is to see how deep the Russian intrusion went into our election. That encompasses the Clinton campaign as well as the Trump campaign allegations. He didn't do it. That blows this whole investigation up. Enter Republican Congressman Louie Gohmert from Texas. Roll the tape.
"If somebody knows they did not conspire with anybody from Russia to affect the election and they see the big Justice Department with people that hate that person coming after them and then a special counsel appointed who hires a dozen or more people that hate that person and he knows he's innocent. He's not corruptly acting in order to see that justice is done. What he is doing is not obstructing justice. He is pursuing justice. And the fact that you ran it out in two years means you perpetuated injustice...".
Perpetuated injustice. That's pretty harsh. But I have to sit here and tell you that Robert Mueller cannot and will not explain why he didn't investigate all of the Russian intrusion. And that means his whole investigation is bogus. Because you can't selectively investigate. So that, every right wing commentator for the past two years has said the same thing. Mueller is not fair. His investigators hate Trump. We know the FBI investigators hated Trump. His whole thing is a witch hunt.
The Democrats today were very well coordinated. If you watched it, you would have seen it. Each one took a different aspect of so called obstruction. Each one. So they they like divided it up to get across to the American people that Trump did indeed try to cover up something. Jerry Nadler, the chairman of the Judiciary Committee started it off. Go.
"And what about total exoneration? Did you actually totally exonerate the president?"
"No.".
"Now in fact your reports expressly states that it does not exonerate the president.".
"It does".
"And your investigation actually found quote, "multiple acts by the president that were capable of exerting undue influence over law enforcement investigations including the Russian interference and obstruction investigations." Is that correct?"
"Correct".
OK. Now as is pointed out very eloquently, it is not Robert Mueller's job to exonerate anybody. He doesn't have the power to exonerate. He only has one power and that is to bring to his bosses, the attorney general at the Justice Department, evidence of a crime that could be prosecuted in a court of law. That's it. So that was Mueller's big mistake and that was made because he doesn't like Trump. Mueller doesn't like him and he knew if he didn't say something that provocative, "well we can't exonerate him". He knew that Trump would just walk on everything. But by giving Nadler and the press, the hate Trump press that window. Well if we knew that he didn't do anything we would have said it. But that was wrong and that was, they spent a lot of time on that today.
All right so just recap. Robert Mueller is a patriot. It would be wrong to disparage the man. He was in over his head. He did not do a thorough investigation and Attorney General Barr, I was on Hannity's radio show today and Hannity played a clip of Attorney General Barr saying that Mueller did a thorough investigation. Mueller did not and we learn that today. That's the most important thing that we learn. He did not. Mueller did not come across as a man in charge of a fair investigation. American people, you can't follow this thing in a micro way, it's crazy, your head will blow off. It's over. Congress leaves for six weeks vacation on Friday. Gone. Tonight you'll get a little cable nonsense. I'll analyze it tomorrow for you. But it's over. It's not going to be impeachment, not going to be indictments after President Trump leaves office. Not going to be anything. Once the Congress comes back after Labor Day it'll be all about the campaign because the Democratic Party is like all over the place. And that'll be the big story.
Brett Tolman, former U.S. attorney for the District of Utah joins us from Salt Lake City. Before you comment on my unbelievable wisdom, I just want to get your overall assessment of what happened today.
"It was striking. I haven't seen Bob Mueller testify for now six years and it was actually shocking. I've never seen him and you use the word befuddled, I've never seen him like that, to the degree he was. He is a tactician typically in those hearings and I could understand him trying to utilize you know repeat the question, do this, do that. But it was very fascinating what we learned after analyzing you know Bob Mueller's testimony. We learned that he didn't draft the report. We learned that he didn't sit in on interviews. We learned that he didn't draft the letter to the A.G.. That he didn't draft his press conference. So you're left wondering, was he just at the head? Did he turn it loose to you know those that were just adverse to the president and they did what they could and they produced Volume 2, which now we know was counter to even his appointment. So the whole thing is striking and I agree with your analysis of it and I'm hopeful this is the end of that chapter."
So I don't know how Mueller could think he would get away with and he had to anticipate because conservatives have been saying this for years. He had to anticipate the dossier questions, the Fusion GPS. The Clinton campaign paying for dirt that were provided by Russians on Trump. He had to anticipate and come in and to tell the American, people I'm not going to say anything about it. And I don't know. We didn't do that. That was beyond our purview. He had to know he was going to look foolish. Did he not?
"Yes he did and it was surprising, Bill that you look for example on the questions that came up that were particularly effective on this Masood character, the politician in Russia. That's a dynamic where it's laid out plain that he lied three times to the FBI. He clearly is at the heart of how this investigation started. Mueller refused to answer questions about it..."
Just explain to Masood is to the folks.
"So this is a politician in Russian, in Russia that does have political connections, he's a professor. He is the one that did give information to Papadopoulos that suggested that the Russians had information about Hillary Clinton. It was then utilized as a basis to suggest that opening an investigation by the FBI on the campaign was justified. And if it's justified then we also then may need a special prosecutor and ultimately it resulted in the special prosecutor being appointed. It was later found out, we found out that he lied three times to the FBI. Everyone around Trump that lied to the FBI got prosecuted but this individual did not.".
Now he's a Russian national and twelve Russian nationals were charged by Mueller.
"That's exactly right.".
He got a pass and Mueller wouldn't explain why. He was asked why but Mueller said it's somebody else is handling it.
"Right and I think that's right and if any of the Russian nationals are going to get charged, it would be the one that lied multiple times to the FBI and maybe at the heart of an investigation...".
That started it all. Right?
"That started it."
OK. So summing up and I have one question about James Comey I'm going to ask you. Summing up, do you agree with me that this is through now? That no matter what Nadler and Schiff and the rest of them try to do, the American public has said, look you don't have it. Let's go someplace else.
"I do agree and there is as a part of me that's very sad to see what happened to Mueller because it is now by his own hand that it's dead.".
He is done. He is done. Now it's gonna reopen in September when the inspector general's report comes out. Horowitz. And this is what I want to ask you about Comey. Because this ties right in. So there is a report on Real Clear Politics, this is a Web site that I use for information. OK. That by the way they don't like me. All right they... I am banned there or something but I don't care because the Web site is pretty useful. So their investigative team says that James Comey, as head of the FBI lied to President Trump by saying Mr. President, you are not the subject of the FBI probe into the Russian intrusion into the election. I guarantee you, you are not the guy. At the same time, Comey was using a person inside the White House to inform on Trump. Do I have that correct?
"You do, you have that exactly accurate according to what we're told the IG report is going to is going to produce. Two quick things on that that are that are important. If that's accurate, then it does mean that Comey lied to Congress. He can lie as an FBI agent to a target, they can lie that they're not investigating them because they justify it under, you know that's their ability to gather information and not put the target on notice. So he lies to the president but it's another thing to lie under oath that he had the president under investigation. And it's clear now that he did. The second point is if that's true and he was under investigation and you have the bias that we see in Struck and Page and and the others. It does suggest that perhaps you don't prosecute those like the Russian politician. You don't go after those that produced the Steele dossier because it fits the narrative that justifies your investigation."
Yeah, you want to get Trump. So all right. We're not going to speculate on Comey and Comey's future but obviously that's been reported. If he did lie to Congress, that's a felony and we'll see. Hey Brett, always a pleasure. Happy you are with our team because you really make it clear to everybody what's happening.

Couple of notes before we move along. I'm going to put this broadcast up on Friday for everybody to watch. I'd also ask you to listen to me on Hannity today because you know, Hannity comes at it from a little bit different perspective than I do and that's an interesting discussion.
All right so President Trump and his people have filed lawsuits against the House Ways and Means Committee, New York state attorney general and the New York state tax commissioner. This is all about, they're demanding that his tax return, state tax returns for New York be made public. Governor Cuomo signed a law saying that should happen. Trump is suing to block it. All right and he'll hold it up. I have no idea how it'll come out but you've got to understand one thing about this. The IRS already vetted the Trump organization. They filed. They paid or didn't pay or whatever. IRS looked at it. That's the legal precedent. The standard. And now New York State wants to get in cherry pick somebodies private returns? No.
Trump administration has fast track deportation. This is more for PR than anything else. They get nine hundred thousand cases of asylum and other things. 900,000 backlog. So Trump wants to speed it up. I don't know if he is gonna be able to do it or not. It's so chaotic. Just the fact the congress is going away for six weeks. What do you think's going to happen at the border in six weeks? Gives the president time and the ability to do things like restrict asylum requests. Which he's doing and a Federal Judge, Timothy Kelly in D.C. said the president had the power to restrict asylum requests. A ruling today. But then mess down there at the border, congress don't want to deal with that. They don't care.
All right so Facebook failed to tell users that their phone numbers might be used for Facebook's advertising. They also shared personal data of people on Facebook with third parties without the consent of the people on Facebook. Because they did that, they have to pay five billion dollars to the federal government in fines. Facebook.

I reported on it, Stephen I know you can't see every episode but that was bogus. I told you from the jump. Mueller is not going to ruin his reputation for doing that. He was asked about it under oath and he said no there was no meeting.

This is off my column. I said if the progressives ever get power there will be an uprising in America. It is getting to the point where regular folks are starting to get really angry. What it looks like? I don't know. Depends on the intrusion. I mean if they start seizing guns for example, seizing assets wealth tax. Tax rates go up 50 60 percent. You're going to see some pretty intense reactions to that.

Art, Mayor de Blasio did condemn the action. So we want to be fair here. I think de Blasio is a terrible mayor but he did right away condemn the action.

All right here's the Final Thought of the Day. I like a variety of different kinds of people. And over the years I have been lucky enough to cultivate some very good friends. Some of them very left wing. Not crazy but their belief system is different than my traditional belief system. We have common ground though. I don't have any friends where there is no common ground. All right it's got to be an outlook of life where you do what you say you're gonna do. You're honest. You work hard. You're respectful. You're not nasty, backstabbing, that kind of thing. So I have common ground with all my friends. But politically speaking, some of them are pretty out there now. I respect that. Why wouldn't I respect that? I remember my mother and father in 1960. My mother is gonna vote for JFK because her mother's maiden name was Kennedy and that was big. My father didn't like Joe Kennedy, the bootlegger. He was going to vote for Nixon. But good naturedly around the table, they well we're gonna cancel each other out. It wasn't any of that. It's what I like. You know, back and forth back and forth.
Now I'll make fun of people that I feel are out there and can't back up their assertions. But I'll do it in a gentle way. So tell me about that... That kind of thing. And they'll try to mock me but I always win. So my advice is and I think you'll be much happier person and have a better life, if you cultivate a wide variety of people. You know I like to have people that have different life experience than I do. One of my friends is Arthel Neville, who is a Fox anchor and her father recently died. Art Neville, a member of the Neville Brothers. And you know, it was sad, he was ill for a while. But Arthel and I... I mean we're kind of different in the way we look at the world. But I learned so much from her. New Orleans, you know Creole culture, African-American. You know she gives me a real perspective that I don't have and that's valuable to me.
So the Final Thought of the Day is, if they're good people, accept them, have fun with it and your life will be better. See you tomorrow.
